Terms of service

Scope and provider

1. These terms apply to the use of GS2THETOP (gs2thetop.com), including the “gs2thetop” script for FiveM and RedM, the APIs, banners and widgets and our Discord bot.
2. The provider is Pascal Burgschweiger, Johann-Sebastian-Bach-Strasse 14, 31171 Nordstemmen, Germany, email: Contact@gs2thetop.com (“we”).
3. Users' own terms do not apply. How we handle personal data is explained in the privacy policy.

Services and ranking

1. GS2THETOP is a toplist for game servers. Visitors can discover, compare and vote for servers; signed-in users can review servers, save favorites, receive notifications, list their own servers and submit ad banners.
2. Use is free of charge. There is no entitlement to particular features, to a server being listed or to a particular rank.
3. By default the ranking is sorted by the number of votes in the current calendar month; counting starts over on the first of each month. Alternatively there is an overall ranking combining votes (45%), reviews (35%) and player count (20%). Visitors can also filter and sort themselves (e.g. by player count, rating or age of the listing). Ad banners have no influence on the ranking; ranks cannot be bought.
4. Player counts, online status and other technical details are queried automatically from the servers or the game makers' server lists. They may be delayed or inaccurate.

Account

1. Sign-in works exclusively via a Discord account. Signing in concludes a free user agreement under these terms.
2. You must be at least 16 years old or have the consent of your parent or guardian. Discord's terms apply in addition. We only accept new accounts with Discord accounts that are at least 14 days old.
3. Each person may use only one account. Accounts may not be sold, transferred or shared. You are responsible for protecting your Discord account against unauthorized access.
4. Moderators and administrators of GS2THETOP act in that role under these terms; their own servers and reviews are subject to the same rules.

General content rules

You are responsible for all content you post (server listings, images, videos, reviews, replies, reports, ad banners, messages to the team). In particular, content is not allowed if it

1. violates applicable law, e.g. insults, defamation, threats, incitement to hatred, unconstitutional symbols or glorification of violence,
2. is pornographic or harmful to minors,
3. infringes third-party rights, e.g. copyright, trademark or personality rights, or publishes other people's personal data without their consent,
4. deceives others, e.g. false information about a server, impersonating other servers or people, phishing,
5. contains malware, scams or links to such content,
6. is spam or contains advertising where it is not intended (e.g. advertising other servers in reviews).

It is also prohibited to disrupt GS2THETOP technically, circumvent security measures, scrape content automatically on a large scale or use the APIs other than as intended.

Voting

1. Each person may vote for each server at most once within 24 hours. Votes must come from real people.
2. In particular, the following are not allowed: votes by bots, scripts or automated services; votes via changing IP addresses, VPNs or proxies to circumvent the limit; bought votes or paying for votes; vote exchanges between servers; bypassing the bot check.
3. Server operators may reward players in the game for voting, e.g. via our “gs2thetop” script. The reward must not depend on particular content (e.g. a positive review).
4. We detect suspicious vote patterns automatically. In case of manipulation we may remove votes, hide the server or ban accounts – even if the manipulation is carried out by third parties in favor of a server and the operator benefits from it.

Reviews and replies

1. Reviews must be based on your own experience with the server and stay factual. Criticism is explicitly allowed; insults and untrue statements of fact are not.
2. You may not review your own server or a server you are involved in, deliberately give competitors bad reviews, or buy or exchange reviews or grant benefits for positive reviews.
3. Operators and co-owners may reply publicly once to each review. Replies must be factual and must not contain personal data of the reviewer.
4. Reviews and replies are checked by an automatic word filter. Content with prohibited words is not saved; reviews with suspicious words or links are only published after review by the team. On servers using our script, a review can receive the “Plays here” badge if the server confirms that you play there.

Server listings

1. You may only list servers that you operate yourself or on whose behalf you may act. One server per game is allowed per account; you can invite other members of your team as co-owners. You are jointly responsible for your co-owners' actions on GS2THETOP.
2. Server details must be accurate and up to date. The server and its listing must comply with applicable law and the rules of the respective game maker or platform (e.g. Cfx.re's terms for FiveM and RedM servers).
3. If a server receives neither votes nor reviews for 30 days, we hide it automatically; you can show it again at any time.
4. If someone else has listed your server, you can take over the listing by proving ownership with our script or by contacting us. After successful proof we transfer the listing to you.
5. The “Verified” badge only confirms that ownership of the server was proven technically – not the quality or lawfulness of the server.

“gs2thetop” script and API

1. For your listed server you receive a simple, non-transferable right, revocable at any time, to use the “gs2thetop” script and adapt it to your needs as long as the server is listed with us. Passing it on or using it for other toplists is not allowed.
2. Keep your API key and your webhook secret confidential. If you suspect misuse, create a new key in the server management; we may block keys in case of misuse.
3. You are responsible for ensuring that the processing of player data on your server (e.g. identifiers and names for vote rewards and the “Plays here” check) is lawful and that your players are informed about it.
4. We provide the script and API without warranty of any particular function. We may develop and change them; we will inform you in good time about changes that require adjustments on your side.

Questions & answers, team search

1. Questions on server pages must relate to the server. Owners and co-owners may answer publicly; the general content rules apply to questions and answers.
2. In the team search, server operators may only post genuine positions for their own server team. Details must be accurate. In particular, positions for which applicants are asked to pay money, buy something or hand over login details, the sale of ranks, and advertising that is not a position are not allowed.
3. Applications may only be used to contact the applicant about the position. Passing them on to third parties or using them for other purposes is prohibited.
4. We are not a party to arrangements between server operators and applicants and accept no responsibility for the content, process or outcome of an application.

Ad banners

1. Signed-in users can submit ad banners in the specified formats. Running ads is currently free of charge. There is no entitlement to approval; we review every banner before it goes live.
2. Approved banners run for 30 days, rotate with other banners and are labeled “Ad”. We do not owe any particular number of impressions or clicks.
3. Banners and target pages must comply with the general content rules and must not advertise gambling, adult or misleading offers. You confirm that you hold the necessary rights to the image and content. If a banner or its target page violates these rules, we may end it early, stating our reasons.

Rights to content

1. Your content remains yours. So that we can display it, you grant us, for as long as it is published on GS2THETOP, the simple, free, worldwide right to store it, make it publicly available and adapt it technically (e.g. resize images, create previews for banners, widgets, sitemaps and social networks).
2. This right ends when you delete the content or your account. Copies in backups are overwritten in the usual cycle; entries in the moderation log are kept as described in the privacy policy.
3. You indemnify us against claims asserted by third parties against us due to a culpable infringement through content you posted, including reasonable costs of legal defense.

Reports, moderation and bans

1. You can report illegal content and violations of these terms using the “Report” function on server listings and reviews or by email to Contact@gs2thetop.com. We review reports promptly, diligently and objectively.
2. In case of violations we may – depending on severity, frequency and fault – take the following measures: hold back, hide or delete content, reset a server's votes, reset a server's verification, restrict features, and ban accounts temporarily or permanently. Bans apply to the Discord account and may be extended to our Discord server. While an account is banned, its servers are not visible in the toplist.
3. We use automated tools to assist us: the Discord account age check, a word filter for reviews and replies, and detection of suspicious votes and reviews. Decisions on hiding, deleting and banning are made by a human member of our team.
4. We inform you of measures taken against your content or account, stating our reasons (on the site, via Discord message or email), unless legal reasons prevent this. If you disagree, you can object by email within six months; we will then review the case again. Your right to seek judicial remedy remains unaffected.
5. In case of serious or repeated violations, in particular vote manipulation, fraud or criminal content, we may ban accounts without prior warning and report criminal content to the competent authorities where we are obliged to do so.

Availability and changes to the service

We strive for uninterrupted operation but cannot guarantee constant availability. Maintenance, technical faults and outages of third parties (e.g. Discord or game makers' server lists) may restrict use. We may develop the free service further, change or discontinue individual features and add or remove games, as far as this is reasonable for you.

Liability

1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
2. As we provide our services free of charge, we are otherwise not liable for slight negligence.
3. Users are solely responsible for their content, and operators are solely responsible for the listed servers, their offers, rewards and rules. We are only liable for damage caused by third-party content in accordance with statutory provisions, in particular once we become aware of an infringement.

Term and termination

1. The user agreement runs for an indefinite period. You can end it at any time by deleting your account under “My account”; your servers, reviews and other data will be deleted.
2. We may terminate the agreement with two weeks' notice. The right to terminate without notice for good cause remains unaffected; good cause exists in particular in case of serious or repeated violations of these terms.

Changes to these terms

We may change these terms with effect for the future if this is necessary because of new features, changes in the law or to prevent abuse. We inform signed-in users of changes at least two weeks before they take effect, on the site or via Discord message. If you do not agree with the changes, you can delete your account at any time.

Final provisions

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you retain the protection of the mandatory provisions of that country.
2. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is the provider's place of residence.
3. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
4. The German version of these terms is authoritative; translations are for information only.
